1.general conditions
SunshineGroup isexclusivily mediator for the owners of the properties. The rental contract is always between the owner of the property and the client. In case of contracting other services, like for example rental cars, whale watching excursions, quad tours as examples, SunshineGroup is as well exclusivilymediator between the company, offering the service and the client. In this case are valid the terms and conditions of the company who offers the service.
2.reservations and conclusions of rental contracts.
The booking of a holiday home does not need a specific form. It can be done by email, verbally or by fax. The booking comes about the acceptance by SunshineGroup. The acceptance does not need a specific form. In the moment of the reservation or a soon as possible, we send the rental contract by email to the client. In case the conditions of the contract is different from the agreement, the contract will be invalidated. In the other case, SunshineGroup keeps offering the same conditions established in the contract. The contract will be valid when the client pays the deposit of 50% of the rental price during these 5 days by transfer to our account, established in the contract.
3.payment and cancellation of the contract
The restpayment of the rental price and the cleaning fee are due latest 4 weeks before arrival by bank transfer.
The client has any time the right to back out of the contract.
The cancellation fee depends on the day of notification of the cancellation in our office.
Cancellation fees:
· Till 60 days before arrival, 50% of the rental price
· From 59days till 35 days before arrival, 65% of the rental price
· From 34 days till 10 days before arrival, 80% of the rental price
· Otherwise 100% of the rental price.
We highly recommend travel insurance which includes a cancellation clause.
SunshineGroup has in the name of the owner the right to dissolve the contract immediately and without any compensation, if the lodger acts against the contract. This can be for example:
· Noise pollution
· Bringing pets without the written confirmation from SunshineGroup
· Using the house with more people than confirmed in the contract or offered on our website
· Intentional or negligent damaging and misuse of the accommodation and/ or the inventory
4.servicios y precios
The prices and services can be seen in our description of our services and price lists as in the rental contract. The rental prices are weekly prices for the whole holiday home. The minimum rental are 7 days. Exceptions are posible as in that each case agreed. Included in the price, if nothing else has been agreed, include electricity (in some houses the conditions are different regarding an aditional use of air conditions, or in the winter, the use of electric heaters ). Also included are sheeds and towels (no beach and pool towels) Not included are the costs for the cleaning, which has to be paid until the reception of the keys of the holiday home. An additional cost of 30 Euro is due in case of late arrivals after 20.00.
5.reclamaciones
The client has the obligation to tell SunshineGroup inmedeately damages or drawbacks noticed in the holiday home. (obligation to co-operate) Generally there will be found a quick and amicable solution.
6.arrival and departure
If there is no other agreement established in the rental contract, the arrival should be between 5 pm and 8 pm. If the client arrives later than 8 pm, the client must inform SunshineGroup in advance. In case of a late arrival after 8 pm, SunshineGroup charges 30 Euros for late arrival, which is due at arrival. We apologise this clause as late arrivals can complicate work of our stuff a lot.
In case the client cant arrive the same day which establishes the rental contract (for traffic or personal reasons for example) the whole amount of rental price is due, the same in case the client has to leave the rented house earyer than established in the contract.
7.Obligation of the client
The client all holiday guests who stay in the rented house have to traet the house and inventory carefully.
Possible house rules must be strictly adhered to.
There are not more persons admitted in the house as established in the contract, booking confirmation or in the website. Additional persons can be refused by SunshineGroup or charged apart from the rental price.
The cleaning of the kitchen furniture, dishes, pots, pans and cutlery is the matter of the client and not included in the cleaning fee.
Does the client or any other person produces a damage in the rented house, the client has to report this incident inmideately and is liable for the damage, caused during the stay.
SunshineGroup is not liable for accidents or physical injurysarised in the house or in the garden of the rented house. The clients use the gardens, istallations and building at one´s own risk. It is very important not to neglect the obligatory supervison of children, especially if there is a pool. A pool can be a very high danger for small children.
8.other
The ineffectiveness of some provisions of the contract do not cause ineffectiveness of the whole contract.
The contracting parties submit themselves expressly to consult the Courts and Tribunals of Chiclana de la Frontera, to resolve any discrepancy that could arise from the interpretation of the rental contract or any of its clauses or agreements.
